Terms of Service
These terms of service apply to the use of Archie (app.getarchie.nl), provided by Aspire Digital. By creating an account or using the service, you agree to these terms.
1. Definitions
- Aspire Digital ("we", "us"): Aspire Digital, established at De Himmen 23, 8618 NP Oosthem, The Netherlands. Chamber of Commerce: 73694010. VAT: NL002328348B45.
- Service: Archie, accessible at app.getarchie.nl, including its transactional emails.
- Account: a unique account giving you access to the Service.
- You: the natural or legal person using the Service.
- Plan: the package linked to your Account, which determines the available functionality and any usage limits.
2. Acceptance
By using the Service you confirm that you are at least 18 years old and that, if you are using the Service on behalf of an organisation, you are authorised to bind that organisation to these terms. Your use is also subject to our privacy policy.
3. Business use only
Archie is intended exclusively for business use in the context of a profession, business, or organisation (such as SEO specialists, marketing agencies, in-house marketing teams, and webshops). By creating an Account you declare that you are using the Service for business purposes and not as a consumer within the meaning of EU Directive 2011/83/EU or Article 6:230g of the Dutch Civil Code.
Should you nevertheless be qualified as a consumer under applicable law, you expressly request that the Service starts immediately upon activation of your Account and acknowledge that, as a result, you lose your 14-day right of withdrawal for the part of the Service delivered before withdrawal. Any free trial period gives you a no-cost evaluation window in which you may cancel at any time.
4. Access and plans
Access to Archie is granted on the basis of an Account activated by Aspire Digital. Each Account is linked to a Plan, which determines available functionality and usage limits. The applicable limits and any fees are agreed with you in advance and are visible in your Account.
An Account may start with a free trial period. During that period you may cancel at any time at no cost. Specific payment and refund terms apply once a paid Plan is activated on your Account and will be agreed separately in that case. Aspire Digital may modify or discontinue a Plan with reasonable prior notice.
5. Account and responsibilities
You agree that you will:
- provide accurate and current information when signing up and using the Service;
- keep your Account credentials confidential and remain responsible for all activity under your Account;
- comply with applicable laws and regulations;
- be entitled to use and share the data you input into the Service or supply through integrations;
- not infringe the rights of any third party through your use of the Service.
6. Prohibited use
You may not:
- misuse the Service or interfere with its availability, integrity, or performance;
- reverse-engineer the Service or any of its components, or attempt to obtain source code or non-public methods;
- use automated scripts, scrapers, or bots to abuse the Service or to circumvent usage limits;
- submit or publish through the Service any unlawful, infringing, or harmful content;
- copy, extract, or use non-public methods, datasets, output, workflows, or analytical logic of the Service to build, train, or benchmark a competing product;
- resell, sublicense, or offer the Service as a standalone product to third parties without our prior written consent.
In the event of a breach, we may suspend or terminate your Account.
7. Third-party services and AI output
To deliver the Service we use third parties for, among other things, hosting, storage, email, authentication, and AI models. The processing of personal data by these parties is described in our privacy policy.
Archie uses language models to generate analyses, briefings, and content. This output is probabilistic and may be inaccurate, incomplete, or factually incorrect (including fabricated sources, figures, or statements). The output is intended to support your decisions, not to constitute an automated decision. You remain responsible for reviewing AI-generated output before publishing it or basing decisions on it (commercial, legal, financial, or otherwise).
8. Intellectual property
The Service and all related software, design, content, methods, and documentation are the property of Aspire Digital or its licensors. Nothing in these terms transfers any intellectual property rights to you, except for the right of use described below.
During the term of your Account we grant you a non-exclusive, non-transferable right to use the Service for your own business purposes. Output that the Service generates for you on the basis of your input may be used in your own business operations. Third-party trademarks remain the property of their respective owners.
9. Feedback
If you share feedback, suggestions, or ideas with us, you grant us a non-exclusive, worldwide, perpetual, irrevocable, and royalty-free right to use, reproduce, and incorporate that feedback into the Service without further obligation or compensation to you.
10. Termination
You may cancel your Account at any time via the Account page. We may suspend or terminate your Account in the event of an (alleged) breach of these terms, in the event of misuse, or if we are required to do so by law.
Upon termination your access to the Service ends. Data retention periods after termination are set out in our privacy policy. Provisions that by their nature also apply after termination (such as those on intellectual property, liability, and governing law) remain in force.
11. Disclaimer and liability
The Service is provided "as is" and "as available". We do not warrant any specific uptime, any specific business results, or the complete accuracy of AI-generated output.
To the maximum extent permitted by law, our total liability is limited to the lower of: (a) the amount you paid us in the twelve (12) months preceding the event giving rise to liability, or (b) one hundred euros (€100). We are not liable for indirect or consequential damages, lost profits, loss of data or business opportunities, errors in AI-generated output, or the unavailability of third-party providers.
Nothing in these terms excludes liability that under applicable law cannot be excluded or limited (such as liability for intent or wilful recklessness).
12. Indemnification
You will indemnify Aspire Digital against claims by third parties arising from: (a) your use of the Service, (b) data you have entered or supplied into the Service, (c) your breach of these terms, or (d) your infringement of third-party rights.
13. Governing law and disputes
These terms and your use of the Service are governed by Dutch law. We will first attempt to resolve disputes by mutual agreement. Failing that, disputes will be submitted to the competent court in the Netherlands.
If a user is nevertheless qualified as a consumer under applicable law, the mandatory consumer rights of the country of their habitual residence apply and prevail over conflicting provisions in these terms.
14. Changes
We may update these terms from time to time. For material changes we will notify you at least 30 days in advance by email or via a notice in the Service. By continuing to use the Service after the effective date, you accept the updated terms. If you do not agree with the changes, you may cancel your Account before the effective date.
15. Miscellaneous
If any provision of these terms is invalid or unenforceable, the remaining provisions remain in full force. These terms are drafted in Dutch. A translation is provided for information only; in case of inconsistency the Dutch text prevails.
